Based on the fact that the a former Apple executive involved in iPod and iTunes development is now leading the development of the Pre, and that there are former Apple employees working on the Pre project for Palm, I cannot believe that Palm would be stupid enough to risk a lawsuit if the Pre truly ships with technology that makes it masquerade as an iPod to iTunes software, unless for some reason it turns out that they licensed the technology from Apple - which I have a hard time believing would do so.
