Hi,

I sell an application on PocketGear, but I live in Canada. In April, 2006 they sent me a W-8BEN tax form to fill out stating that I was a non-US citizen, which I did, and mailed it back.

PocketGear is now withholding 30% of the developer royalty payment. In previous years, I just filed the PocketGear income in my Canadian taxes.

I have some questions if anybody can answer them, I'd appreciate it:

1. Is 30% correct? Should I have any tax charges withheld at all if I live in Candada?
2. Do I need to file the income in my Canadian taxes since they now take taxes away in the US? I don't see why I should be double-taxed. Ideally, I would just like to pay Canadian taxes as I have done in the past, as they will be less than 30%.
