my active oync keeps defaulting to comm 1 and i need it on comm 3 or 5
so that i don't need to use the cradle
I use blutooth so the port can't just keep changing on me, lest I not be able to connect

Check that your HKEY_LOCAL_MACHINE\SOFTWARE\Microsoft\Windows CE Services contains a key "SerialPort" corresponding to the port you need.
Then check if your HKEY_CURRENT_USER\Software\Microsoft\Windows CE Services contains a key "SerialPort" pointing to COM1:
If this is the case, then delete the key HKEY_CURRENT_USER\Software\Microsoft\Windows CE Services\Serial Port entry and the key on Local Machine will take precedence.
Pay attention to the names!

Thanks I'll try this when I get home. If this isn't the problem then I'll post back here. But a regedit sounds like the solution.
