On that day NTP will file an injunction to bar the BlackBerry from being sold by RIM in the United States. Jim Balsillie, Co-CEO of RIM, downplayed the chance that an injunction against the BlackBerry would be successful. The February 13th court date is set to review a jury award to NTP for US$23.1 million as a result of a lawsuit the company filed against RIM over its use of allegedly patented wireless e-mail technology found in the BlackBerry handheld. RIM plans to appeal the decision in its entirety, stating that the "jury verdict was wrong as both a matter of law and fact. We firmly believe that the jury verdict was unduly prejudiced by errors in the Court's pre-trial and trial rulings."

NO chance they (RIM) will let this happen!! They have more than $500 million in the bank. I don't think they will sneeze at the $23 mil...okay, maybe sneeze but that's about it!

NTP is making big huffing noises so they can get their $$ as quickly as possible. RIM will try to stretch it out as close to the date as possible in hopes of negotiating something better than $23 million cash. Not likely to happen but they'll try.

I do not think RIM will loose this, but this is real shame on the whole patent system - how it is used and abused....
