Firmware upgrade
If you got your phone through Cingular or for a Cingular account, contact Cingular and ask them to replace the phone.
Many people have reported that Cingular has been replacing the phone. They are aware of the problems with the phone, volume, which has firmware earlier than the 1.3 version.
