I would have had a serious talk with that manager. I would have insisted that the restaurant pay for it, but that the employee not be disciplined for it. I would have reminded him how often I was in there supporting his shack and how if I wasn't compensated, I'd start visiting the place across the street (and recommend everyone else do the same).
In any case, it sounds like maybe you would have been doing the waiter a favor if you got him fired...
P.S.: I've had a Pantech Duo from AT&T for a while now and it's still the best SP on the market (in my opinion).
